iPod Earphones Replacement

Hi guys and gals, I got a question. The grey rubber ring around my iPod earphones are starting to rip and tear on both phones. I am talking about the newer model earphones that come with the the Shuffle. I have only had them for a couple months and they are tearing in the same spots on both phones. I know Apple gives it a one year warranty automatically and was wondering if you think they would replace them. If you could see these things, you would probably agree that it's just plain bad worksmanship. I hardly even wear these things and I paid $40 for them, this should not be happening. What do you guys think?:headphone
