In the system report under usb, I only see 2.0.

I saw a posting using Clover to modify the patch to , but the patch is already installed.

any thoughts?

Best thought is to tell us your model Mac. That determines USB port speed, not the operating syatem.

Your machine is from 2009, USB 3.0 was designed and likely in device around 2011 or so and USB 3.1 came out in 2013. So I'd be amazed at whatever 'patch' you found that is going to make a piece of hardware support something that wasn't even out when it was manufactured.

You only have USB 2.0 ports, if you want USB 3.0 support, you need to upgrade to a newer machine.

Your iMac is only capable of USB 2.0 and Firewire. You can not modify that with or without a patch as that is built into the hardware. As Harry said, the operating system has nothing to do with that.
