Up to 2 days ago I would have answered yes to all three of those questions. But not anymore

2021 M1 MacBook Pro 14" macOS 14.4.1, Mid 2010MacBook 13" iPhone 13 Pro max, iPad 6, Apple Watch SE.
Neither my wife or I are currently using "Optimise Storage" and certainly not storing Desktop & Documents in iCloud but there are some documents in iCloud Drive that are not stored locally. I have downloaded a few of the more important ones without issue. Of course like others I have two local backups so the few evicted files are still backed up in TM.
