As legal battles heat up over who owns the rights to the Unix operating system, another dispute has been quietly simmering over the rights to the Unix name itself.

Apple Computer is being sued by The Open Group, the San Francisco company that claims ownership of the Unix trademark, for using the term Unix in conjunction with its Mac OS X operating system without a license. Apple has countersued, asking a judge to declare that the trademark is invalid, because the term Unix has become generic.

on the Open Group site they state:

"Regarding SCO's positioning on UNIX, The Open Group would like to make it clear that SCO holds the rights only to the operating system source code originally licensed by AT&T and does not own the UNIX trademark itself or definition of what a UNIX system is.
Reference to the SCO web site show that they own certain intellectual property and they correctly attribute the trademark. SCO has never owned "UNIX"."

so i dont know what their argument is. they even say they dont own the trademark and apple did use it

Sounds like a frivolous lawsuit to me. I wish there were laws againt frivolous lawsuits. It would help save us tax payers, major money.
