Is safari only come with Panther version?

Safari was introduced with OS X 10.2 and has been included with each version since.

Coz I had mine previously with OSX10.3.9 (panther) but after i reformat back to the original OSX10.1.2 & OSX9.2.2 i cant see it.

Mac Pro 8x3.0ghz 12gb ram 8800GT , MBP 2.16 2GB Ram 17 inch.
You will have to upgrade back to 10.3 or even to 10.2 in order to get safari.
