I have this issue too. Only in safari. It's annoying.

I've noticed that mine disappears when I use the arrows to scroll. When I use the touch pad it comes back. I suppose this is to keep it out of your viewing area.

On mine it sometimes disappears on the tab bar and bookmark toolbar area. It makes it incredibly annoying when trying to close a tab!
