RapidShare illegal to download?

So it's come to my attention that there are illegal videos and illegal cds up on rapidshare. As a law student I'm curious whether it is in fact illegal to download off rapidshare?

If this topic is inappropriate I apologize. I'm just curious as to the legality of these file sharing services.

It is illegal to download or otherwise copy and distribute copyrighted material without the expressed permission from the copyrighter.

Doesn't matter the means that you are using to download the files. If the content is copyright protected, then it is illegal to download it
