I will be getting a new ipad and was wondering if I can transfer over the apps from my old one.

I am sure someone will correct me if I am wrong but I think the apps will transfer as long as you are using the same iTunes Music Store account. It is probably possible to restore the apps from a backup of your current device. There are some instances where that might not be a good idea: The newer device supports a more modern OS than he first gen iPad for example.

You can either transfer apps using a "restore" in iTunes from one of your previous backups, or you can simply re-download the apps from the App Store at no charge provided you're using the same iTunes account. (edit: doh, what Sylv said)

Either way, if any app is not compatible with your newer machine you will be informed and that app won't download, but that would be a very unlikely thing to have happen.
