Ipod Touch Software stuck on version 2.2.1

My friend gave me this Ipod Touch that I believe is first generation. I'm trying to sync apps that I have purchased to it but they won't sync because it says that the software version is not up to date. When I try to update the software version, it says it is the latest version (2.2.1) which I believe is not even close to the latest version. Please Help!
