In order to create a new partition on my Macbook, it is telling me I have to re-install Leopard

I have an external HDD and my files completely backed up using Time Machine

I have programs on my Mac such as Office, Adobe CS4, Maya, that I need to keep (and don't have the original discs for)

If I re-install Leopard from scratch and then load my files from Time Machine, will all the programs I have on my Mac still work, or will I need to reinstall them all?

Most programs would still work, but the ones you specifically mention will not. They always need to be re-installed from the original discs.

You should either recover your original discs, or, if you don't have them, contact the vendor about getting new copies. If your "old" copies aren't legit, this is a sign that you should do the right thing.
