Great disappointment

so I unwrapped my shiny new ipod touch 32gb, plugged it in, downloaded the update, sync'd my tunes etc.

having a play around I discover that the cool bit doesnt work, it wont rotate when flipped!!
spent about 3 hrs looking online for a solution, took it into the store where i got it, 2 weeks. 2 weeks to get a replacement 'you took our last one sir'

ok and breathe...........

return it for a refund and buy one from another store. I don't know what German rules are like on customer rights, but in the UK a faulty item is worthy of a full refund, no questions asked.
