Maybe they waited to sue Psytar so when the closing arguments come around there will be some money to take away. ;)

I'm assuming they have a reason for waiting, but we can only guess as to what that is.

My guesses are either:

A. They wanted to concentrate on getting all the legalities nailed out with the iPhone, MobileMe, etc. etc. And now they are shifting resources to deal with Psystar.

B. They waited for Psystar to ship enough units so that demanding a recall would be guaranteed to bankrupt them.

They knew about psystar all along, the day after 10.5.4 was released psystar already had it on their new systems and were offering all there customers a free update of it. Thats when Apple filed the complaint about them.
