Apples Replacement Policy

Hey guys i was wondering if apples replacement policy is to replace due to specs or due to purchasing value:

For instance in December 2008 i bought my Unibody Macbook Pro and decked it out with all the trimmings i upgraded the RAM to 4 gigs and the Processor to 2.8 ghZ..which in all came up to 3400$ CA with apple care

Well now the new summer macbooks came out and the same model (with even more HD space) is the standard model and the upgraded model for 3400$ with apple care is a 3.06 ghZ processor and 4 gigs of ram

Now my macbook is dieing a slow painful death the harddrive is clicking and failing and the speakers are rattling and i am on my 3rd repair...the apple care specialist told me if it doesnt get fixed this time i get a new laptop

Using this example my question, do i deserve the NEW standard model which is what i have OR do i deserve the new UPGRADED model which is the value i paid originally.

To be honest i dont really care what the outcome is, but if I hear that i deserve the upgraded model i will probably fight to get it from them because of all the trouble/time/driving ive had to do to get this macbook fixed 3 times...

From the experience's I've heard here on this forum, from people that have received replacement computers (desktops or laptops) covered under Apple's warranty...Apple has always been more than fair with the replacement computer's they give people.

but that doesnt really answer my question about which computer i should be given as a replacement

How the heck do I know which computer you will be given...do you think I have a "crystal ball" or something?

You'll get what you get, which more than likely will be better than what you have right now...which will be a working computer!

At this time you aren't even at the point where Apple has offered to replace your laptop...you're still in the repair stage.

I have received two replacement computers from Apple. They will send you the computer that matches where your's was in the lineup. Perhaps they will take into consideration any upgrades that you had installed if you push them.
