refurb iPhone or iPod Touch?

hi
I just don't know what to do:

I could buy an iPod Touch 16 GB für 399, or an refurb iPhone 8GB for only 349...

Do I also have to take this ATT Contract when I buy a refurbished one?
What would you do?

(If I have to take the contract I d chose the iPod)

if you want to use the phone fuction then you will have to take the contract.. if you don't want to use it as a phone go for the ipod touch.
