upgrade OS X 10.5.8 to lion?

I tried to upgrade to OS X 10.6.3 first but I rcvd a dialog "This software cannot be installed on this computer"
Does this mean I can't upgrade at all?

It might help to let us know how you were going about upgrading from OS 10.5.8 to 10.6.3.

downloaded 10.6.3 and proceeded to install hench the dialog

There is no legal download of OSX Snow Leopard. You're not going to get any help here.

Fixed that.

There is no legal download of OSX. You're not going to get any help here.

Not true my friend, since OS X Lion was indeed a very legal download..you are, however, entirely correct that prior to OS X Lion, there was no legal download version of OS X available..

As already mentioned...if your MacBook currently has OS 10.5.8 on it...and the only thing you did was "download" OS 10.6.3 (no Apple retail disk involved upgrading to OS 10.6)...then this is a violation of Apple's EULA. There were/are no Mac OS X upgrades that are legally downloadable before OS 10.7 Lion.

There are legally downloadable "OS updates"...but not OS upgrades!
