I just bought a MacBook Pro a month ago. I'm wanting to set up an email account @mac.com I was wondering do you have to subscribe to MobileMe or is there a way to just set the account up? Also does it already come with the free trial out of the box?

They are no longer available. The service has been replaced by MobileMe.

People who already had @mac.com addresses can keep them if they subscribe to MobileMe, but new ones are no longer available.

Once you bought the mobileme for a year and you create your e-mail address, can you keep the address if you stop using mobileme aferwards?

No - the email is part of the mobileme service. No mobileme - no email through mobileme.
