IMac problem, get pictures back after computer crashed and new operating system insta

Alright the problem that Im facing is that my iMac got a grey screen of death (crashed). So i tried to get the files I wanted on to my other computer, made a partition. For like a second then I was just like forget it and brought it to a guy to do it. He then checked it told me that there nothing on the hard drive its wiped, I was like no way. He was like everything gone, I was like no way. So he said I could restore the computer so it like new so i was like OK. Then now after the fact everything done with, I hear this software call data rescue 3 could get everything back. So i was wondering it would work, the thing is before the computer crashed I had Leopard and iphoto and now when the guy reinstalled everything he put tiger back on to it. So I was wondering if should get leopard first then try the data rescue software or get it now while I have tiger. Now the computer like new there nothing on it just been download music. Want to see if I could get back any pictures.
Any suggestion would be great, please help

It's too late to use Data Rescue 3 since everything on the hard drive has probably been overwritten by the installation of Tiger. The time to use any recovery software is right away before writing anything to the hard drive.
