MacBook - Can't Get Rid Of This Wallpaper! Need Help!

I downloaded the earthdesk off the apple site thinking it would look good, and it wasn't, when i put it on it has 'NOT LICENSED EVALUATION USE ONLY' scrawled across the middle of the screen so my mac now looks crap because of it. I tried to delete it and every time I try to empty the trash it says 'Item is in use'. I've tried to change it back to what it was previously and then about 2 minutes later it automatically goes back to being the earthdesk, even when ive changed it for a minute or two and go to delete it from the trash it still says 'file in use', I've had a look and it says that its a Unix Executable File. Does anybody know how I can get rid of it? Thanks.

I think that the original file that you downloaded is still sitting on the system somewhere , have you checked "Pictures" if it is there drag it to the Trash then delete, if its not there do a search to see were it is sitting.

If its locked, give this a try:
Ctrl-click it, and pick "Get Info." In the lower right of the window that comes up, click on the lock icon - enter your password, and you'll be able to change the access levels for the file - set it so you can read and write, and you'll be able to delete the file.

You need to kill the process that is using the file you are trying to delete. Look in Activity Monitor and see if there is a process called Earthdesk, or similar.

Also, I have tried Earthdesk in the past and they have an uninstaller right in the pref pane. Maybe you should reinstall it, since it sounds like you have already trashed some files, then go into the pref pane and use the uninstaller provided there. I am sure that will completely remove it from your system.
