To be honest I think this is the norm (certainly in the UK).

If you look on the Apple store it doesn't say that it comes with 3.0

It says 3.0 is 'available' for the iPod touch but the spec never mentions it. It doesn't mention Bluetooth either. Something that was only enabled for iPod Touches with 3.0

I don't think you'll see iPod touches coming with 3.0 out-of-the-box until a 3rd gen touch is released.
I'm reasonably sure this is what happened when 2.0 came out. No iPods came with 2.0 until the 2nd gen iPod Touch was released.
