Hard Drive Swap: Instaling OS X

Hello,
I am about to swap my hard drive out, as the factory one seems to be going south fast. The problem is this: The drive I want to put in is partitioned (with data on it), but does not yet have the os on it.

First of all, I already tried installing the os on the external drive, the installer would not let me(from what i've read, I'm assuming this is because I have a hardware specific version, not the full retail version). Is there any way around this?

Also, if I do install the OS on a partitioned hard drive, will it erase both partitions in order to do the installation, or will my backed up data be safe on the other partition?

No. The OSX install disc will not do ANY partitioning or erasing unless you specifically tell it to.
